1. Acceptance of Terms

These Terms of Service govern access to and use of Veloquence, including the mobile app, public website, support channels, account features, free features, Premium features, and related services.

By creating an account, downloading the app, using the app, buying a subscription, or using the website, users agree to these Terms. If a user does not agree, they should not use Veloquence.

2. The Veloquence Service

Veloquence is a vocabulary-learning app with daily word cards, definitions, pronunciations, usage examples, saved words, favorites, practice access, scheduled quizzes, progress tracking, reminders, streaks, XP, and optional Premium features such as Say It pronunciation practice from the learning card. The website provides product, support, privacy, terms, and account deletion information only.

3. Eligibility

Users must be at least 13 years old, or older if required in their country or region to use online services without parent or guardian consent. Users under the age of majority in their location may use Veloquence only with permission from a parent or guardian who agrees to these Terms.

4. Accounts and Security

Users are responsible for providing accurate account information, keeping sign-in credentials secure, and promptly notifying Veloquence about unauthorized account use. Users are responsible for activity that occurs through their account unless the activity results from Veloquence's failure to use reasonable security measures.

The public website does not provide a login, password field, dashboard, account portal, or protected route. Account creation, settings, subscription status, and deletion controls belong in the mobile app or are handled through support.

5. Free Plan, Premium, and Subscriptions

Veloquence may offer a free plan supported by ads or sponsor breaks, and may offer Premium monthly or yearly subscriptions. Free features may include daily word cards, saved words, favorites, practice access, scheduled quiz access, basic progress features, and sponsor breaks. Premium features may include Say It pronunciation tools, audio features, reduced sponsor breaks, advanced practice features, or other paid benefits shown in the app at the time of purchase.

Prices, taxes, billing periods, trial availability, renewal dates, and included features are shown before purchase and may vary by country, platform, currency, promotion, and store. If pricing shown in the app store or payment provider differs from a marketing page, the purchase screen controls.

6. Payments, Renewal, Cancellation, and Refunds

Purchases may be processed through Apple App Store, Google Play, or Stripe. The provider used for purchase handles payment authorization, taxes, renewal, cancellation tools, refund processes, and payment method storage under its own terms.

Subscriptions may renew automatically unless cancelled before the renewal deadline shown by the provider. Deleting the app or deleting a Veloquence account does not necessarily cancel a subscription. Users must cancel through the app store account, payment provider account, or purchase provider used for the subscription.

Refund eligibility is controlled by the purchase provider and applicable law. Veloquence can help with support questions, but it may not be able to issue refunds directly for purchases controlled by Apple, Google, or another payment provider.

7. Limited License

Subject to these Terms, Veloquence grants users a limited, personal, non-exclusive, non-transferable, revocable license to use the app and website for personal vocabulary learning. Users may not copy, sell, rent, sublicense, distribute, host, or commercially exploit Veloquence unless Veloquence gives written permission.

8. Educational Content and Accuracy

Vocabulary content, definitions, pronunciations, examples, synonyms, antonyms, explanations, quizzes, scores, and other learning materials are provided for educational and informational use. They may contain mistakes, omissions, or outdated information.

Veloquence is not a professional advice service, exam-preparation guarantee, legal or medical reference, translation authority, clinical speech assessment, or therapy tool. Users should not rely on Veloquence as the sole source for high-stakes decisions.

9. Pronunciation Practice

Premium Say It pronunciation practice can be started directly from a learning card and requires microphone permission. Scores and feedback are automated estimates and may be imperfect. Results can vary because of accent, device microphone quality, background noise, network conditions, pronunciation model limitations, and other factors. The feature is for practice only and is not a medical, clinical, or speech therapy service.

10. User Content, Feedback, and Reports

Users may submit support messages, word reports, feedback, screenshots, or other materials. Users are responsible for anything they submit and must have the rights needed to submit it.

Users grant Veloquence a worldwide, non-exclusive, royalty-free license to use submitted feedback, reports, and support content to operate, troubleshoot, improve, secure, and promote Veloquence. This license does not transfer ownership of user content.

11. Acceptable Use

  • Do not use Veloquence for unlawful, harmful, abusive, misleading, infringing, or harassing activity.
  • Do not submit content that violates another person's rights or contains malware, spam, or deceptive material.
  • Do not copy, scrape, crawl, harvest, or bulk export Veloquence content or user information without permission.
  • Do not reverse engineer, decompile, tamper with, or attempt to access source code except where law clearly allows it.
  • Do not bypass subscriptions, payment systems, ads, access controls, rate limits, security controls, or platform restrictions.
  • Do not interfere with servers, networks, providers, app stores, analytics, ads, billing, or other users.
  • Do not use Veloquence to train competing models, datasets, or commercial products without written permission.

12. Intellectual Property

Veloquence, including its name, logo, brand, software, interface, design, app screens, content, compilations, text, images, audio, code, and related materials, is owned by Veloquence or its licensors and is protected by intellectual property laws. These Terms do not give users ownership of Veloquence intellectual property.

13. Third-Party Services

Veloquence may rely on third-party services such as app stores, payment processors, authentication providers, cloud databases, hosting providers, ad networks, analytics providers, diagnostics providers, notification services, device platforms, and support tools. Third-party services may be governed by their own terms, privacy notices, fees, availability, and technical rules.

14. Privacy

Veloquence's collection and use of information is described in the Privacy Policy. Users should read the Privacy Policy before using the app, creating an account, using Premium Say It pronunciation features, enabling notifications, or buying Premium.

15. Account Deletion and Termination

Users can request account deletion through the app where available or by following the instructions on the Account Deletion page.

The in-app deletion process may require a clear confirmation step, such as typing "DELETE", and may provide a short cancellation countdown before deletion is completed. Once completed, account deletion is irreversible.

Veloquence may suspend, restrict, or terminate access if a user violates these Terms, creates risk or legal exposure, misuses the service, disputes or fails to pay charges, harms other users or providers, or if continued access would be unlawful or commercially impractical.

16. Availability, Updates, and Changes

Veloquence may update, add, remove, pause, or discontinue features, content, pricing, providers, or plans. The app may be unavailable because of maintenance, outages, provider issues, app store review, security work, network issues, or events outside Veloquence's control.

17. Disclaimers

Veloquence is provided on an "as is" and "as available" basis to the fullest extent permitted by law. Veloquence does not promise uninterrupted availability, error-free operation, perfect content accuracy, perfect pronunciation scoring, permanent availability of any feature, or that the service will meet every user's needs.

18. Limitation of Liability

To the fullest extent permitted by law, Veloquence will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, business opportunity, or learning outcomes arising from or related to use of the service.

Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or consumer rights that cannot be excluded by law.

19. Indemnity

Where permitted by law, users agree to defend, indemnify, and hold Veloquence harmless from claims, losses, liabilities, damages, costs, and expenses arising from user content, misuse of Veloquence, violation of these Terms, violation of law, or violation of another person's rights.

20. Consumer Rights

Users may have mandatory consumer rights in their country or region. Nothing in these Terms is intended to reduce rights that cannot be waived or limited by contract. If these Terms conflict with mandatory consumer protection law, that law controls to the extent of the conflict.

21. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, except where mandatory local law gives a user additional rights or requires a different governing law. Courts in England and Wales will have non-exclusive jurisdiction, meaning users may also be able to bring claims in their country of residence where required by consumer law.

22. Changes to These Terms

Veloquence may update these Terms from time to time. The latest version will be posted on this page with a new last updated date. Material changes may also be communicated in the app or by email where appropriate. Continued use after changes take effect means the user accepts the updated Terms.
